Soil Pollution Prevention Responsibility

In order to implement the requirements of laws and regulations such as the Law on the Prevention and Control of soil pollution in the People's Republic of China, the Action Plan for the Prevention and Control of soil pollution and the measures for the Management of soil Environment of Industrial and Mining Land (for trial implementation), and to implement the main responsibility of enterprise pollution prevention and control, the government of Huancui District of Weihai City signed a letter of responsibility for the prevention and control of soil pollution with Weihai Xinyuan Chemical Co., Ltd. Specific objectives and requirements are as follows:

1. clear responsibility subject. Weihai Xinyuan Chemical Co., Ltd. assumes the main responsibility for the prevention and control of soil pollution on the land used by the enterprise. AccordingThe principle of "who pollutes, who governs", causes soil pollution, to bear the main responsibility of risk control or governance and repair. If the subject of responsibility changes, the unit or individual that inherits its creditor's rights and debts after the change shall bear the relevant responsibilities; if the land use right is transferred according to law, the transferee of the land use right or the responsible person agreed by both parties shall bear the relevant responsibilities.

2. Weihai Xinyuan Chemical Co., Ltd. shall perform the following obligations and responsibilities and take effective measures to prevent new soil and groundwater pollution.

(I) strictly control the discharge of toxic and harmful substances, and report the discharge situation to Huancui Branch of Weihai Ecological Environment Bureau on an annual basis.

(II) establish a system for the investigation and treatment of hidden dangers of soil pollution to ensure that toxic and harmful substances are continuously and effectively prevented from leaking, losing and dispersing. Regularly carry out hidden danger investigation in key areas (including production areas, raw material and waste storage areas, storage areas, transfer areas, pollution control facilities, etc.). According to the investigation, formulate a rectification plan, report the rectification plan to the Huancui Branch of Weihai Ecological Environment Bureau for the record, and regularly report the progress of rectification measures. The investigation and treatment of hidden dangers shall be truthfully recorded and files shall be established.

(III) are required to carry out soil and groundwater monitoring on their land every year. Formulate and implement the monitoring plan, make the results public, and report the monitoring data to the Huancui Branch of Weihai Ecological Environment Bureau for the record.

(IV) prevent soil contamination by demolition activities. Where facilities, equipment or buildings or structures are dismantled, a work plan for the prevention and control of soil pollution, including emergency plans for environmental emergencies, shall be formulated, and shall be filed and implemented with Weihai Ecological Environment Bureau and Huancui District Industry and Information Bureau 15 work reports before the demolition activities.

(V) the use of land for production and operation is changed or before the land use right is recovered or transferred, the land use right holder shall conduct a soil pollution investigation in accordance with the regulations, and the investigation report shall be sent to the real estate registration institution of Huancui District as the real estate registration data, and shall be reported to Huancui Branch of Weihai Ecological Environment Bureau for the record.

When (VI) new, reconstruction and expansion projects, when carrying out environmental impact assessment of construction projects, the investigation of the current situation of soil and groundwater environment of industrial and mining land shall be carried out in accordance with the relevant technical specifications of the state, the investigation report shall be prepared, and the basic database of environmental impact assessment shall be filled in as required.

(VII) put an end to the illegal transfer and dumping of hazardous wastes. Implement the Guidelines for the Development of Management Plans for Hazardous Waste Generating Units, establish hazardous waste accounts, and strictly manage hazardous waste. According to the interpretation of the Supreme People's court and the Supreme People's Procuratorate on Several Issues concerning the application of law in handling criminal cases of environmental pollution (legal interpretation 〔2016 No. 29), the illegal discharge, dumping, disposal of hazardous waste of more than three tons, shall be investigated for criminal responsibility according to law; Knowing that others do not have a hazardous waste business license, provide or entrust them to collect, store, use, and dispose of hazardous waste, Those who seriously pollute the environment shall be punished as a joint crime.

(VIII) prevent environmental emergencies from polluting the soil. Improve the emergency plan for environmental emergencies of the unit, and supplement and improve the contents related to soil pollution prevention. If an environmental emergency involves soil pollution, emergency measures for soil pollution prevention and control shall be initiated; after the emergency, the contaminated land that needs to be treated and repaired shall be formulated and implemented.

(IX) prevent secondary pollution caused by treatment and repair works. If it is necessary to carry out the treatment and restoration of contaminated soil, necessary measures should be taken to prevent secondary pollution caused by excavation, storage and transfer of contaminated soil. To prevent secondary pollution of the repaired soil, it is necessary to redevelop and utilize the repaired land in strict accordance with the designated use, and strictly abide by the corresponding risk control system to ensure that the repaired soil will not be secondary pollution.

3. Weihai Huancui District People's Government organizes the assessment of Weihai Xinyuan Chemical Co., Ltd.'s implementation of this letter of responsibility every year.

4. "Weihai Xinyuan Chemical Co., Ltd. Soil Pollution Prevention and Control Responsibility Letter" in duplicate, Weihai Huancui District People's Government and the unit that signed the responsibility letter each keep one copy.
